Introduction

1. These terms and conditions govern the sale of products by Sumi-e Shop and the use of the website www.sumi-e.it. All products sold on www.sumi-e.it are located in Italy.

2. Commercial relationships are governed exclusively by the following terms and conditions, excluding any other agreement unless agreed in writing.

3. All offers are non-binding and are generally valid only while stocks last. Sales contracts are considered valid upon written confirmation.

4. All prices on www.sumi-e.it are VAT-exclusive and may change without notice. Sumi-e Shop is not responsible for errors or inaccuracies in product descriptions, images, or names.

5. For every order, Sumi-e Shop issues an invoice for the goods shipped, based on the information provided by the Customer at the time of order. No changes to the invoice will be possible after it has been issued. The invoice is sent only upon request, as provided for online sales.*

6. These terms and conditions may be modified by Sumi-e Shop without prior notice and will be effective from the date of publication on www.sumi-e.it.

7. Trademarks and copyright. ALL RIGHTS RESERVED. Any use, printing, or copying of materials on this website, other than for browsing, selecting products, and placing orders, is strictly prohibited. Any framing of this website is prohibited.

A. Users

1. Users are divided into Unregistered Users and Registered Users.
a. Unregistered Users are those who interact with the website without completing the registration process.
b. Registered Users are those who sign up by entering the required information in the designated pages.

2. Continued use of the website implies acceptance of these Terms and Conditions.

3. To register, a Private Registered User must:
a. provide their name, surname, phone number, email address, address, country, and postcode/location;
b. choose a password of at least 6 characters and confirm it (if forgotten, it can be recovered via the “Forgot your password?” function);
c. accept these Terms and Conditions.

4. After submitting the registration data, the website will send a confirmation email containing a link that must be clicked to complete registration.

5. Through their profile, the Registered User can modify personal settings, track shipments, and manage default shipping addresses.

6. The Registered User is solely responsible for their account and the confidentiality of their password, and must immediately notify the website of any theft, loss, or unauthorized use of their account.

B. Acceptance of Sales Conditions

1. The contract between Sumi-e Shop and the Customer is concluded upon acceptance, even partial, of the order by Sumi-e Shop, which reserves the right to accept orders at its sole discretion. Acceptance is deemed tacit unless otherwise communicated. By placing an order, the Customer confirms they have read all instructions provided during the purchase process and fully accepts these Terms and Conditions.

2. If the Customer is a final consumer (i.e., a private individual purchasing for non-professional purposes), after completing the online purchase they should print or save an electronic copy of these Terms and Conditions.

3. Any right of the Customer to compensation or indemnity, as well as any contractual or non-contractual liability for direct or indirect damages to persons or property caused by the non-acceptance, even partial, of an order is excluded.

C. Purchase Process

1. The Customer may only purchase products listed on www.sumi-e.it at the time of the order, as described in the relevant product sheets. Technical and purchase-support information on www.sumi-e.it is intended as generic informational material only.

2. Product images may not perfectly represent the actual item and may differ in color, size, markings, or accessories. Images are for illustrative purposes only.

3. Correct receipt of the order is confirmed by Sumi-e Shop via an automatic reply to the Customer’s email address, containing the “Receipt Date” and “Order Number” to be used in all subsequent communications. The Customer must verify the accuracy of the order details and promptly report any corrections needed.

4. Product availability is shown on the website. As simultaneous access by multiple users may affect availability, Sumi-e Shop cannot guarantee the allocation of ordered goods. If a product is unavailable, we will contact the Customer promptly.

5. For promotional products, Sumi-e Shop reserves the right to accept orders with reduced quantities, subject to Customer notification and acceptance; otherwise the order will be considered cancelled.

D. Payment Methods

All prices are in Euros (€) and include VAT; shipping costs are not included. Stripe and its international partners process transactions on behalf of Sumi-e Shop. Payment is required in advance by Credit Card, PayPal, or Bank Transfer.

1. Credit Card

a. Upon completing an online transaction by credit card, the Customer’s bank will authorize and reserve the purchase amount.
b. Accepted cards include Visa, Maestro, Mastercard, American Express, and other circuits. The amount is charged when the order is fulfilled.
c. Sumi-e Shop may request additional information or a copy of documents proving card ownership. Failure to provide these may result in order cancellation.
d. Transactions for orders outside Italy will be converted by the card company at their current exchange rates.
e. In case of order cancellation, Sumi-e Shop will request the reversal of the transaction. Sumi-e Shop is not responsible for any delays in releasing the reserved amount by the bank.
f. If payment is declined, this is solely at the discretion of the Customer’s bank or Stripe. Sumi-e Shop has no means to intervene, as payments are processed on an external platform.
g. Card network rules prohibit: (i) cash refunds for credit card charges unless required by law; (ii) initiating a refund more than five calendar days after issuing a credit to the Customer; (iii) accepting cash or equivalent items in exchange for a refund.

2. PayPal

a. Upon completing an order with PayPal, the Customer is redirected to the PayPal login page.
b. The order amount is charged to the PayPal account upon order acquisition.
c. In case of order cancellation, the amount will be refunded to the Customer’s PayPal account. Sumi-e Shop is not responsible for any delays in releasing funds by PayPal.
d. If payment is declined, this is solely at the discretion of PayPal. Sumi-e Shop has no means to intervene.

3. Advance Bank Transfer

Orders are shipped only upon actual receipt of payment, which must be made within 5 business days of order acceptance. After this period, the order is automatically cancelled. The bank transfer reference must include the order number provided in the order confirmation email.

In case of order cancellation, the amount will be refunded to the Customer’s bank account. Sumi-e Shop is not responsible for any delays in releasing funds by the bank.

E. Sales Tax

For orders shipped outside Italy, local sales tax or import duties may apply. These are not included in our prices and remain the Customer’s responsibility.

F. Transaction Security

Online credit card transactions are processed through a Secure Server using SSL (Secure Socket Layer) encryption. Sumi-e Shop does not have access to Customer credit card data and therefore cannot be held responsible for any fraudulent use of credit cards by third parties on www.sumi-e.it.

J. Warranties

1. All products sold by Sumi-e Shop are covered by a 24-month warranty for conformity defects, pursuant to Legislative Decree No. 24/02. To benefit from warranty assistance, the Customer must retain the documentation received with the purchased goods.

2. The 24-month warranty applies to products with conformity defects, provided they are used correctly and for their intended purpose. It is reserved for private consumers (individuals purchasing for non-professional purposes). In case of a conformity defect, Sumi-e Shop will, at no cost to the Customer, restore conformity through repair/replacement or a price reduction, up to contract termination.

3. If Sumi-e Shop is unable to replace a warranty product, it may, with the Customer’s consent, substitute it with an equivalent product of equal value.

4. No compensation may be claimed from Sumi-e Shop for delays in warranty repairs or replacements.

5. Where warranty terms require the return of a product, it must be returned in its original packaging, complete with all parts. It is recommended to place the original packaging inside a second box to prevent damage. Labels or adhesive tape must not be applied directly to the original packaging.

6. Sumi-e Shop disclaims all responsibility for direct and indirect damages arising from use of the website and reserves the right to modify or remove any information or products at any time without notice. Please note that handcrafted products (such as brushes, bowls, hand-painted works, etc.) may vary slightly in size and color.

K. Complaints

Any complaints must be addressed to Scuola Internazionale di Sumi-e, c/o Bodai Dojo, Via Fratelli Ambrogio 25, 12051 Alba (CN), using the designated form, which must be sent by registered mail with acknowledgment of receipt within 5 days of receiving the goods. Customers may expedite the process by sending the form to shop@sumi-e.it.

M. Jurisdiction and Applicable Law

The sales contract between the Customer and Sumi-e Shop is concluded in Italy and governed by Italian law. For civil and criminal disputes arising from the distance sales contract, if the Customer is a private consumer, jurisdiction lies with the court of the Customer’s municipality of residence. In all other cases, exclusive jurisdiction lies with the Court of Bolzano.

N. Final Provisions

If any clause of this contract is declared wholly or partially void, the remaining clauses shall remain valid.

Right of Withdrawal

Pursuant to Legislative Decree No. 21 of 21 February 2014, amendments were made to the Consumer Code in implementation of Directive 2011/83/EU on consumer rights.

A. Standard Withdrawal Instructions

Right of Withdrawal

The Customer has the right to withdraw from the contract, without stating any reason, within 14 days. The withdrawal period expires 14 days from the day on which the Customer, or a third party designated by the Customer (other than the carrier), takes physical possession of the last item.

To exercise the right of withdrawal, the Customer must notify us (Scuola Internazionale di Sumi-e, c/o Bodai Dojo, Via Fratelli Ambrogio 25, 12051 Alba (CN), email: shop@sumi-e.it) of their decision to withdraw from the contract via an explicit statement (e.g., a letter sent by post or email). The standard withdrawal form below may be used, but is not mandatory.

To meet the withdrawal deadline, it is sufficient that the Customer sends the withdrawal notice before the withdrawal period expires.

Goods must be returned intact, complete with all parts, in their original packaging where possible, showing no signs of wear or use beyond normal handling.

The right of withdrawal is subject to the following conditions:
– It applies to the product purchased in its entirety; partial withdrawal is not possible.
– It applies exclusively to products purchased on www.sumi-e.it; products ordered on the basis of custom quotes or Customer-specific requests are excluded.

Effects of Withdrawal

If the Customer withdraws from this contract, all payments made to Sumi-e Shop will be reimbursed, including delivery costs (except for any additional costs resulting from the Customer’s choice of a delivery method other than the least expensive standard delivery option offered), without undue delay and in any case no later than 30 days from the return of the goods.

Refunds will be made by bank transfer. The Customer must promptly provide the bank details for the refund (ABI – CAB – account number of the invoice/receipt holder). The Customer will not incur any costs as a result of the refund.

The Customer must return the goods to Scuola Internazionale di Sumi-e, c/o Bodai Dojo, Via Fratelli Ambrogio, 12051 Alba (CN), without undue delay and in any case within 14 days of notifying us of the withdrawal. The direct cost of returning the goods is borne by the Customer. The shipment remains under the Customer’s full responsibility until confirmed receipt at our warehouse.

In case of damage during return shipping, Sumi-e Shop will notify the Customer within 5 business days of receiving the goods, to allow them to file a claim with their chosen carrier and obtain reimbursement of the product value (if insured). In this case, the product will be held for the Customer’s collection, and the withdrawal request will be cancelled.

Sumi-e Shop accepts no responsibility for damage or loss of returned goods shipped without insurance. The right of withdrawal is void if the product’s integrity (packaging and/or contents) is compromised for reasons unrelated to shipping. The right of withdrawal does not apply to products specifically ordered by Sumi-e Shop at the Customer’s request, nor to purchases made by resellers or companies.

Shipping & Delivery

1. Shipping Methods

Sumi-e Shop ships worldwide. Products are shipped via various national and international couriers. Where possible, based on the destination, the Customer will be offered a choice of carriers (listed in point 2.d). Shipping costs are the Customer’s responsibility and are clearly displayed at the time of ordering.

2. Carrier Transport Conditions

By purchasing from Sumi-e Shop, the Customer authorizes the Association to enter into a freight transport contract with the chosen carrier.

a. This authorization is finalized upon payment and executed when Sumi-e Shop sends an order confirmation email.
b. The contract with the carrier is governed by Italian law. Carrier liability is regulated by Art. 10 of Legislative Decree No. 286/2005 for domestic shipments (€1/kg), and by the CMR Convention for international shipments.
c. The carrier reserves the right, but is not obligated, to open, inspect, and examine any shipment at any time.
d. The Customer authorizes the Association to conclude, in their name and on their behalf, a transport contract with one of the following carriers: BRT, POSTE ITALIANE SDA, DHL, TNT, UPS. Terms and Conditions are available at: www.brt.it / www.sda.it / www.tnt.it / www.ups.it / www.dhl.com. The Customer is solely responsible for any breach of the carrier’s General Terms and Conditions and agrees to hold Sumi-e Shop and the Association harmless from any related liability.

3. Delivery Times

Products may be subject to changes without notice due to production or regulatory requirements. If a product is discontinued or unavailable, the Customer will be notified promptly and any payment already made will be fully refunded, with no penalties charged to Sumi-e Shop.

For items in stock, shipping typically takes 2 to 5 business days. For custom hand-painted works, delivery timelines will be agreed with the Customer individually.

Delivery is made Monday to Friday, 9:00–18:30, excluding public holidays, to the address provided at the time of order. Collection is at street level; couriers are not required to deliver to upper floors. The Customer will be notified by email when the order has been shipped.

No compensation for damages arising from delays in collection or delivery estimates is due to the recipient. Unless “Guaranteed Transport” is expressly indicated, transit times are estimated in business days (Monday to Friday) from parcel dispatch. Weekends, non-business days in transit and destination countries, public holidays, as well as delays caused by customs, public administration, or other events beyond Sumi-e Shop’s control (weather, logistics) are never included in delivery time estimates. The route and means of transport remain at the carrier’s sole discretion.

You may contact us before placing an order to enquire about delivery times. We are committed to monitoring each order and meeting every Customer’s needs.

4. Shipment Tracking

Shipments can be tracked using the order number or via the carrier’s website with the tracking number, generally available from the day after collection. Tracking is generated once the carrier has collected the shipment and scanned it at the departure hub.

The first day of transit is counted from the day after collection. For international shipments, tracking updates may take longer as the parcel passes through various international depots.

If tracking has not been updated for more than 48 hours, please contact Sumi-e Shop, who will request further information from the carrier.

Please note: it is always the Customer’s responsibility to monitor the shipment until delivery.

Shipments can be tracked in two ways:
a. In your Sumi-e Shop personal account, under “Track Shipment” for the relevant order.
b. On the carrier’s website by entering the carrier tracking number.

5. Failed Delivery

After a first failed delivery attempt due to the recipient’s absence, a notification will be sent by SMS/email (only by DHL). The Customer may exercise a release option by 11:59 PM via the link in the notification. If no action is taken, a second delivery attempt will be made automatically the following day. Available options include:
– redelivery to the same address
– redelivery to a different address

If the second attempt also fails, a notice will be left with details of the Pickup Point where the shipment will be held. The recipient may collect the shipment within 7 business days.

If the shipment is not collected within the storage period, it will be returned to Sumi-e Shop. In this case, only the product purchase cost will be refunded; shipping costs already paid to the carrier will not be reimbursed.

6. Receipt of Goods

Upon delivery, the Customer must check:
a. that the number of packages matches the invoice.
b. that the packaging is intact and undamaged. If not, the delivery receipt must be signed with the note: “Accepted with reservation pending inspection – damaged package.”

In case of discrepancies or damaged items, the Customer must photograph the package and the non-conforming product, and send the photos to shop@sumi-e.it. Once the claim is resolved, the damaged or missing goods will be reshipped or refunded, at Sumi-e Shop’s discretion.

c. Goods travel at the Customer’s risk. Any complaints must be communicated immediately to the delivery courier. Sumi-e Shop cannot be held responsible for any damages, direct or indirect, caused by delays, damage, or loss of the shipment by the carrier.
